Statute:

I. General Provisions

1.      The provisions of these regulations (hereinafter referred to as the "Regulations") apply to all sales and delivery contracts concluded with NS GLOBAL TRADE SPÓŁKA z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ via the online store www.labubusklep.pl (hereinafter referred to as the "Store"), regardless of the means of distance communication used in a given case, for contact or conclusion of contracts between consumers and the enterprise without the physical presence of the parties to the contract.

2.      The Regulations are addressed to all registered and unregistered users of the Store (hereinafter referred to as "Customers") and define the rules for registering and using the Store account, placing orders in the Store and the rules for concluding sales contracts.

3.      A necessary condition for starting to use the Store and placing orders is to read and accept these Regulations.

4.      The Customer may place an order without having to permanently register his/her data in the Store's database, provided that he/she has read and accepted the provisions of these Regulations.

5.      The online store may only be used by persons over 18 years of age.

6.      Customers registering in the Store and making purchases there provide their personal data and consent to their processing by NS GLOBAL TRADE under the terms set out in the Privacy Policy.

7.      Customers can use the Store by registering and creating a private account (hereinafter referred to as the "Customer Account"), which stores the personal data specified in the registration form and information about the Customer regarding their orders placed in the Store. The Customer has the right to terminate the agreement concluded with NS GLOBAL TRADE SPÓŁKA z OGRANICZONĄ ODPOWIENOŚCIĄ regarding the Customer Account at any time by submitting a declaration of intent to the Seller regarding deletion of the Customer Account. To do so, the Customer should contact the Seller.

8.      The Customer is responsible for providing false personal data. NS GLOBAL TRADE SPÓŁKA z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ reserves the right to refuse to process or cancel a product order if the Customer has provided false data or if such data raises reasonable concerns about its accuracy. In such a case, the Customer will be informed by phone or email about the reasons for the cancellation. In such a situation, the Customer has the right to explain all circumstances related to verifying the accuracy of the provided data and canceling the order. In the absence of data enabling the Store to contact the Customer, the Store will provide all necessary explanations after the Customer has contacted them.

9.      The Customer is responsible for all transactions made using their login and password, unless the login or password information was disclosed to a third party through no fault of the Customer. The Store undertakes to make every effort to protect the login and password from disclosure. The Customer undertakes to make every effort to protect the login and password from disclosure to unauthorized third parties.

10.   The Store is not responsible for the Customer disclosing their login or password to the Customer Account to third parties. In the event of expiration, change, or deletion of the email account provided by the Customer when registering the Customer Account, the Customer should notify the Store.

11.   The Customer declares that all data provided by him for the purpose of fulfilling the order is true, but the Store is not obliged to verify their truthfulness and correctness.

II. Placing an order

1.      The Store sells goods exclusively online. To make purchases in the Store, you must have an active email account.

2.      The store accepts online orders 24 hours a day, seven days a week. Orders are accepted at http://www.labubusklep.pl

3.      To place an order, the Customer must select products from the Store's available offerings, including sizes and quantities, by taking the necessary technical steps based on the messages displayed to the Customer on the Store's website. The Customer selects the products to be ordered by adding them to the Store's shopping cart.

4.      All prices are quoted in Polish zloty and include all necessary components, including VAT. The price listed for each product is binding from the moment the Customer places an order and confirms its fulfillment. It does not change even if the Store's prices increase.

5.      Until the selection of the ordered products is confirmed by clicking the "Order" button, the Customer has the option to make changes and modifications to the products in the order.

6.      After confirming the ordered products, the Customer is obliged to provide his/her contact details (applies to unregistered Customers), select the delivery method and payment method.

7.      When selecting the delivery method, the Customer will be informed about the shipping costs or that the order is covered by free delivery.

8.      The Customer's submission of an order (confirmation via the "Complete purchase" button) constitutes an offer by the Customer to enter into a sales contract, in accordance with the Terms and Conditions. For unregistered Customers, placing an order requires prior review and acceptance of the Terms and Conditions and the Store's Terms and Conditions of Use. The information posted on the Store's website does not constitute an offer to enter into a contract under the Civil Code.

9.      The store accepts the following payment methods: GPay, Blik, card payments, PayU, Apple Pay, and PayPal. Acceptable payment methods are subject to change and will be displayed to the customer each time during the checkout process.

10.   After placing and paying for an order, the Customer will receive an email confirming receipt of the order by the Store. If the Customer selects prepayment via an electronic payment system as their payment method, the order will be processed after the Store receives confirmation of payment from the electronic payment system operator.

11.   Order fulfillment begins upon receipt of the order. The customer receives an email confirming order fulfillment, which is considered the moment the sales contract is concluded.

12.   Only properly placed orders will be processed. A properly placed order means that the Customer has provided all information necessary to conclude and execute the sales contract, which information is truthful, current, and accurate. The order will not be processed if:

1.      a) the Customer providing incorrect, incomplete or false contact details that make it impossible to complete the order;

2.      b) incorrect placement of an order by the Customer, which makes it impossible to complete it;

3.      c) the Store has objectively justified its opinion that in the case of an order placed by the Customer, there is an attempt to commit fraud, which should be understood as any action by the Customer in connection with the placement and execution of the order that is unlawful, in particular such actions as: breaking the Store's security, using the Store's platform contrary to its intended purpose, using someone else's login or password or impersonating another person, as well as intentionally misleading the Store.

13.   The Store reserves the right not to process Orders placed by Customers in violation of paragraph II, section 12 of the Regulations.

14.   The Store may contact the Customer at the e-mail address provided by the Customer or by telephone, at the contact telephone number provided by the Customer, in order to clarify doubts, confirm the order or in other matters related to the execution of the order.

15.   By accepting the provisions of the Terms and Conditions, the Customer consents to the Store issuing and making available invoices and corrective invoices electronically, in accordance with Article 106n paragraph 1 of the Act of 11 March 2004 on Value Added Tax (Journal of Laws of 2022, item 931, as amended). The invoice is issued when all goods ordered by the Customer are completed and ready for shipment. The invoice will be attached to the shipment containing the products or will be made available to the Customer in electronic form via email to the email address provided by the Customer when placing the order or creating a Customer Account.

16.   In the event of withdrawal from the distance sales contract by the Customer who is a consumer in accordance with Article 221 of the Act of 23 April 1964, the Civil Code (hereinafter referred to as the "Civil Code") and the Store receives the returned goods, and if the complaint is accepted, the Store will send a corrective invoice to the Customer's e-mail address.

17.   The Store may enable Customers to use discount codes. Discount codes may have time and quantity restrictions, may be addressed individually or to all Customers, and may also apply only to specific products available in the Store. Detailed terms and conditions for using the codes are specified in the terms and conditions or in the relevant instructions provided to the Customer along with the promotional code.

III. Order Fulfillment

1.              Delivery of goods takes place only within the territory of the Republic of Poland in the manner chosen by the Customer and specified in the order.

2.              The Store is obligated to deliver the shipment to the buyer within a maximum of 28 days from the order confirmation date. If the Store fails to deliver the order within this timeframe, regardless of the reasons for the delay, the Customer has the right to withdraw from the contract. Upon receiving notification of withdrawal from the Customer, the Store has 14 days to refund the amount paid by the Customer (including the delivery fee).

3.              In the event of unavailability of some of the goods covered by the order, the Customer will be immediately informed about the status of the order and will decide on the method of its execution (partial execution, extension of the waiting time, cancellation of the entire order).

4.              In the event of circumstances that prevent the execution of the placed order, the Store reserves the right to suspend its execution and undertakes to immediately notify the Customer of the situation.

5.              If the Customer decides to cancel the order after having previously paid, an automatic refund of this amount, along with shipping costs (if applicable), will be made within 14 days of the Store receiving the email informing the Customer of the cancellation of the order. However, if the Customer decides to partially fulfill the order, the previously paid amount will be applied towards the partially fulfilled order, and the remaining balance will be automatically refunded within 14 days of the Store receiving the email informing the Customer of the partial fulfillment of the order.

6.              Upon receiving the order from the courier, the customer should inspect the condition of the shipment. If the packaging is damaged or tampered with, the Store recommends completing a damage report in the presence of the courier and notifying the Store.

IV. Pre-sale

1.              The Store reserves the right to introduce special "pre-sale"/"pre-order" offers, under which the Customer will have the opportunity to purchase goods from the new collection before it is released for regular sale.

2.              The Store's sales regulations also apply to pre-sales, taking into account the differences indicated in this paragraph IV.

3.              The contact details provided when placing an order must be accurate and up-to-date to enable the Store to provide information about the status of the order.

4.              Payment for the goods is made when the order is placed.

5.              The order fulfillment deadline will be indicated by the Store on the website for goods covered by the "pre-sale" and will also be communicated to Customers in an e-mail confirming acceptance of the order for fulfillment, but will not be longer than 30 days.

V. Withdrawal from the contract

1.              In accordance with Art. 27 of the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2020, item 287, i.e. of 2020.02.21, as amended) (hereinafter referred to as the "Consumer Act"), the Consumer has the right to withdraw from the sales contract without giving any reason within 14 days from the day on which the Consumer came into possession of the products or on which a third party indicated by the Consumer other than the Courier came into possession of the products.

To meet the withdrawal deadline, simply send a statement regarding your exercise of your right to withdraw from the sales contract before the withdrawal deadline expires. In the above-mentioned case, the Customer is obligated to return the purchased goods immediately, no later than 14 calendar days from the date on which they withdrew from the contract. The purchased goods should be returned to the following address: ul. Gałczyńskiego 22 , 11-040 Dobre Miasto  

3.              The Store will refund payments made by the Consumer immediately, no later than 14 days from the date of receipt of the declaration of withdrawal. The Store may withhold reimbursement until the Product is received or the Consumer provides proof of sending it back, whichever occurs first.

4.              In the event of withdrawal, the contract is considered null and void, and the Customer is released from all obligations. If the return is made within the specified timeframe, the Store guarantees a refund of the full amount paid for the goods and shipping costs using the same payment method used by the Customer, unless the Customer expressly consents to a different refund method that does not incur any costs for them.

5.              The Store is not obliged to reimburse the Customer for any additional costs incurred by him, including shipping costs higher than the cheapest shipping option offered by the Store.

6.              The customer bears the direct cost of returning the goods, including shipping costs. The seller does not accept shipments returned at the recipient's expense.

7.              Returned products should be complete, free from signs of use and damage, and, if possible, include the packaging and invoice.

8.              The customer is liable for any reduction in the value of the goods resulting from their use in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.

9.              In the case of returns of Labubu BLINDBOX figurines, we require that the figurine's packaging is intact.   Due to the nature of the product, we do not accept returns of unpacked figurines, as they are not suitable for resale.

VI. Complaints

1.      The products offered in the Store are either brand new or, due to limited availability, sourced from private sellers, giving them a second-hand, used, collector's item feel. Upon arrival at the warehouse, regardless of whether the item comes from an official distributor or a private seller, it is verified for authenticity. All products sold in the Store are authentic.

2.      The Store is liable to the Customer who is a consumer (and an entrepreneur with consumer rights) for the conformity of the goods with the contract under the provisions of the Consumer Rights Act. The Store is liable to the Customer who is not a consumer under the warranty for defects under the provisions of the Civil Code.

3.      If the goods do not conform to the contract, the Customer who is a consumer may request that they be repaired or replaced. The Store may replace the goods if the Consumer requests a repair, or the Store may repair the goods if the Consumer requests a replacement, if bringing the goods into conformity with the contract in the manner chosen by the Consumer is impossible or would require excessive costs for the Store. If repair or replacement are impossible or would require excessive costs for the Store, the Store may refuse to bring the goods into conformity with the contract.

4.      The consumer may submit a declaration of price reduction or withdrawal from the contract when the Seller has refused to bring the goods into conformity with the contract; the lack of conformity of the goods with the contract persists despite the Seller's attempts to bring the goods into conformity with the contract; or the lack of conformity of the goods with the contract is so significant that it justifies price reduction or withdrawal from the contract without prior recourse to replacement or repair.

5.      The above rights apply to defects that appear within two years of the product's delivery date. When submitting a complaint, please include proof of purchase.

6.      Complaints can be submitted in any form chosen by the Customer, in particular by sending the form and the product in question to the Store at the following address: Gałczyńskiego 22, 11-040 Dobre Miasto, nsglobaltrade@ns-globaltrade.com . If possible, please attach proof of purchase (e.g., a copy of the receipt or invoice) and a description of the defect, including the Customer's request under the warranty.

7.      The customer will receive information on how the complaint will be handled within 14 days from the date the Store receives the courier parcel containing the complained goods.

8.      If the complaint is upheld, the Customer will receive a full refund, including the costs of shipping the product to the Customer and returning the defective product to the Store. The refund will be made immediately, but no later than 14 days, using the same payment method the Customer selected, unless the Customer has expressly requested a different refund method, provided that it is technically possible for the Store.

9.      If a warranty claim is rejected, the goods will be returned together with an opinion as to the invalidity of the claim.

10.   An EU-wide platform for online dispute resolution between consumers and businesses (ODR platform) is available at http://ec.europa.eu/consumers/odr. The platform provides an interactive access point for consumers and businesses seeking out-of-court resolution of disputes arising from online transactions.

VII. Personal data protection

The Seller collects and processes personal data provided by Customers in accordance with applicable law and in accordance with the Privacy Policy available on the Store's website.

VII. Final Provisions

1.              Polish law applies to the sales contract for products in the Store. The contract is concluded in Polish.

2.              The Store reserves the right to introduce and withdraw offers, promotions and to change the prices of products in the Store without prejudice to the rights acquired by the Customer, including in particular the terms of sales contracts concluded before the change was made.

3.              In matters not regulated by these Regulations, the provisions of generally applicable law shall apply, including in particular the provisions of the Civil Code, the Consumer Act and the Act of 18 July 2002 (Journal of Laws 2020, item 344, i.e. of 2020.03.03) on the provision of services by electronic means.

4.              These Terms and Conditions do not exclude or limit any rights of the Customer who is a Consumer, which they are entitled to under mandatory provisions of law. In the event of a conflict between the provisions of these Terms and Conditions and mandatory provisions of law granting Consumers broader rights, those provisions shall prevail.

5.              NS GLOBAL TRADE SPÓŁKA Z OGRANICZONĄ ODPOWIENOŚCIĄ reserves the right to change the provisions of these regulations for important reasons, in particular:

about        a) in order to adapt them to generally applicable legal provisions,

about        b) to eliminate any provisions that may violate the interests of Customers,

about        c) in connection with a change or extension of the offer of services and goods provided by the Store,

about    d) in connection with the change, limitation or extension of the business profile of NS GLOBAL TRADE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ,

about    e) due to organizational changes on the part of NS GLOBAL TRADE SPÓŁKA Z OGRANICZONĄ ODPOWIEALNOŚCIĄ.

6.              The changes referred to in paragraph 2 do not bind Customers who placed an order before the changes to the terms and conditions below were introduced, unless the changes result from mandatory provisions of law. Customers will be notified of any changes to the terms and conditions via the email address provided when placing the order.

7.      If any changes are made to the Terms and Conditions, the Store will inform Customers of the new Terms and Conditions electronically (to the email addresses provided in the Customer Account or when placing orders) and by publishing the new Terms and Conditions on the Store's website at least 14 days before the new Terms and Conditions come into effect. If the Customer does not accept the new Terms and Conditions, the Customer has the right to terminate the agreement with NS GLOBAL TRADE SPÓŁKA Z OGRANICZONĄ ODPOWIEALNOŚCIĄ regarding the Customer Account at any time by submitting a declaration of intent to delete the Customer Account.

8.              If any provision of these Regulations is changed or invalidated by a final court decision, the remaining provisions shall remain in force and shall bind the parties.

9.      We would like to inform you that all comments and suggestions from our Customers are always welcome and desirable in accordance with the policy of NS GLOBAL TRADE SPÓŁKA Z OGRANICZONĄ ODPOWIENOŚCIĄ, whose main objective is to act in the best interests of the Store's Customers.
